Mark Smith is a partner in the law firm of Smith Trostle & Huerta LLP.  He has practiced Administrative Law for over twenty-five years, twenty-one of which have been devoted to Public Utility Law.  His clients have included industrial and commercial end-use customers, governmental and public entities, independent power producers and a variety of other entities needing legal assistance with electric, telecommunications, gas, water and sewer supply and rate issues.  His practice focuses on counseling, negotiation, contract and legislative analysis, as well as representation of clients in contested hearings and rulemaking proceedings before Texas state agencies, and in judicial appeals of agency orders.  Mr. Smith served as a member of the five-person Synchronous Interconnection Committee created by the Texas Legislature to explore and report to the Legislature on the legal and policy implications of synchronously interconnecting ERCOT to the Southwest Power Pool.  More recently, Mr. Smith served as the industrial representative on the Public Utility Commission’s Retail Pilot Project Negotiated Rulemaking Committee, and was subsequently a member of the Commission-appointed Retail Pilot Implementation Working Group.  Mr. Smith was the Chair of the Demand Side Working Group in 2002, and has been a member of the Wholesale Market Subcommittee since 2002.

From 1979 to 1983, Mr. Smith worked for the Texas General Land Office, serving as agency counsel for oil and gas and public lands issues.  From 1983 to 1989, Mr. Smith worked in a variety of positions at the Public Utility Commission of Texas, including Assistant General Counsel, Senior Administrative Law Judge and Assistant Director of the agency’s Hearings Division.  Since 1990, Mr. Smith has been in private practice, formerly as a partner and administrative head of the public utility practice at the Austin firm of Brown McCarroll & Oaks Hartline, as a partner at Casey, Gentz & Sifuentes, L.L.P. and Sifuentes, Drummond & Smith, L.L.P., and currently, as a partner at Smith Trostle, LLP.  Mr. Smith holds a bachelor of arts degree with honors in history and a J.D. from the University of Texas School of Law.  His professional memberships include the Texas Bar Association, the Austin Bar Association, and the Gulf Coast Power Association.
