J. Kay Trostle is a partner in the law firm of Smith Trostle & Huerta LLP. Her practice focuses on representation of clients in administrative and regulatory litigation dealing with a wide array of utility matters. Her practice includes representing clients before the Public Utility Commission of Texas (“PUC”), Railroad Commission of Texas, Texas Commission on Environmental Quality (“TCEQ”), State Office of Administrative Hearings (“SOAH”) and the Electric Reliability Council of Texas (“ERCOT”).
Ms. Trostle’s clients in the electric industry include industrial and commercial customers, governmental entities, cooperatives, retail electric providers (“REPs”), financial investors, and landowners affected by routing of transmission lines. She has appeared in numerous proceedings including rate cases, certification of REPs, securitization, fuel rates and reconciliations, ERCOT fee and complaint cases, PUC enforcement matters, and transmission line routing and certification. She also provides expert witness testimony in support of the recovery of rate case expenses incurred by utilities and municipalities.
Ms. Trostle also represents municipal and rural water and wastewater utilities, as well as customers in proceedings before TCEQ and other regulatory agencies related to wholesale and retail rate disputes and CCN matters. She has also represented competitive local exchange carriers in negotiations with ILECs and arbitrations before the PUC. Ms. Trostle was formerly an Administrative Law Judge at the PUC, a Hearings Examiner at the Texas Water Commission (predecessor agency to TCEQ) and the Director of the Utility Division at SOAH. In these positions, she was personally responsible for presiding over complex contested case proceedings, including all forms of rate regulation, complaints and certification. Ms. Trostle has been licensed to practice law in Texas since 1979 and has focused on administrative law since 1981, and more specifically on utility law since 1986. She serves as a member of the Administrative and Public Law Section of the State Bar of Texas, and is a Master member of the Robert W. Calvert American Inn of Court. She holds both a Bachelor of Arts degree with high honors and a Juris Doctor from the University of Texas.
