Electricity and Gas

Our electric and gas practice includes advising and advocating for clients on market changes reflected in new laws and regulations, handling transactional matters involving the acquisition or sharing of power, transmission and retail services, and negotiating and drafting contracts essential to protect the clients' interests in the competitive electric market.  We have extensive experience in advising and representing large industrial facilities, educational institutions and commercial customers on competitive electric matters including negotiation of utility commodity contracts.  In addition, we counsel clients offering competitive power supply alternatives, and participate in contested cases regarding the siting of electric transmission lines, rate cases, acquisitions and mergers, complaints, and enforcement actions.


The firm's telecommunications practice encompasses regulation and litigation as well as transactional matters involving local, long  distance and advanced services in Texas; as well as mobile and fixed wireless voice communications; wireless data services; and equipment technologies essential to these telecommunications entities.  The firm's telecommunications experience includes interconnection matters, area code and numbering issues, consumer issues, building access and wireless issues, Operational Support Systems and dark fiber. 

In addition, we have kept pace with the dynamic nature of the telecommunications industry and in recent years have counseled our clients regarding wireless data issues, the USA Patriot Act, distance learning, telemedicine, the Digital Millennium Copyright Act, Voice over Internet Protocol, and fiber to the home.  Furthermore,  we assist clients' interactions with the Universal Service Administrative Company ("USAC"), including USAC's Schools and Libraries Division and have experience reviewing Educational Broadband Service ("EBS" formerly "ITFS") lease agreements.

Water and Wastewater

Our representation of water and wastewater utility clients has involved contract negotiations, assistance with customer complaints, and litigation between retail public utilities. The firm represents retail public utilities, including municipalities and water districts, in proceedings before municipal and state regulatory agencies.
